METROPOLIS, IL – This installment focuses on two new laws fundamentally changing how employees interact with their contracts and their colleagues. Effective January 1, 2026, the state has strengthened protections against overly restrictive contract clauses and expanded paid leave for life-saving organ donation.

The Workplace Transparency Act (WTA) Gets Tougher

Illinois has long sought to prevent employers from using contract language to silence employees or force them into unfavorable legal forums. The 2026 amendments to the Workplace Transparency Act (HB 3638) go significantly further:

1. Right to “Concerted Activity” Protected

The new law explicitly prohibits any agreement—including employment contracts or separation agreements—from restricting an employee’s right to engage in “concerted activity” to address work-related issues.

• What this means: You cannot be prevented from discussing wages, benefits, working conditions, or other mutual aid with your colleagues. Any contract that tries to limit this collective action is void and unenforceable.

2. Limiting Employer’s Unilateral Terms

Employers can no longer unilaterally impose certain terms as a condition of employment for Illinois workers. Clauses that attempt to do the following are now against public policy and void:

• Shorten the Statute of Limitations: Employers cannot shorten the time you have to file a claim.

• Apply Non-Illinois Law: Contracts cannot force an Illinois employee to use another state’s law to govern their claim.

• Require Out-of-State Venue: Employers cannot require employees to bring their claims to a court or venue outside of Illinois.

3. Stricter Confidentiality Rules

For any settlement or separation agreement concerning alleged unlawful employment practices (like harassment or discrimination), confidentiality clauses are now much more difficult to enforce:

• The employer must provide separate and distinct consideration (money) specifically for the promise of confidentiality, apart from the consideration provided for the release of claims.

Paid Organ Donation Leave Expanded

Making a life-saving organ donation is an act of extreme generosity, and now, more Illinois workers are protected if they choose to do so. The Employee Blood and Organ Donation Leave Act has been expanded:

• Part-Time Employees Included: Previously, the law only covered full-time employees. Starting in 2026, part-time employees are now also entitled to up to 10 days of paid leave within a 12-month period to serve as an organ donor.

• Pay Calculation: For part-time workers, the paid leave will be calculated based on their average daily pay over the previous two months of employment.

• The Benefit: This change removes a significant financial barrier, ensuring that part-time workers do not have to choose between their income and providing a life-saving gift.

Scott’s Law: The Rule That Protects Every Roadside Worker

While the most recent major update to the “Move Over” Law, known as Scott’s Law, took effect earlier, its continued enforcement and the severe penalties associated with violations remain a top focus for law enforcement in 2026. This is the one law every driver must internalize.

• What it is: Scott’s Law mandates that when approaching any stationary vehicle with flashing lights—be it a police car, ambulance, tow truck, or even a private vehicle with its hazard lights on—you must:

  1. Change Lanes: Move to a lane away from the stopped vehicle, if safe and possible.

  2. Slow Down: If changing lanes is not safe, you must substantially reduce your speed and proceed with extreme caution, giving the roadside scene the widest possible berth.

• The Reality: Violations of this law are strictly enforced and carry fines of up to $10,000, with felony charges and driver’s license suspension if injury or death results. Southern Illinois law enforcement will continue to prioritize enforcement in 2026, protecting the lives of emergency workers, maintenance crews, and stranded motorists.

Ending the Waiting Game: Immediate Missing Person Reports

A crucial public safety law, Ending Waiting Periods for Missing Person Reports (SB 0024), takes effect this year. While not strictly a “traffic law,” it dramatically affects how police respond to potential incidents, including those originating on the roadway.

The New Mandate

The law eliminates the ability of law enforcement to impose a waiting period before accepting a missing person report.

• Immediate Reporting: Police must take the report immediately upon it being filed.

• No Excuses: Law enforcement can no longer refuse to take a report based on factors like:

  • The person’s age (if they are an adult).

  • Their suspected mental health status.

  • The possibility that the person left on their own or may have been involved in a non-criminal incident.

Why This is Critical

In any missing person case, especially those that start with an abandoned vehicle or a delayed return from a drive, the first few hours are the most crucial.
